1. Acceptance of Terms

By downloading, installing, or using the Mood Trend application ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Definitions

  • "App" refers to the Mood Trend mobile application.
  • "Developer" refers to Midori, the creator and operator of the App.
  • "User" refers to any individual who downloads, installs, or uses the App.
  • "Premium" refers to the paid subscription tier of the App.

3. Medical Disclaimer

Important: Please read this section carefully.

  • Mood Trend is NOT a medical device.
  • The App is not intended to diagnose, treat, cure, or prevent any medical condition, including but not limited to bipolar disorder, depression, or any other mental health condition.
  • The mood data, graphs, and insights provided by the App are for informational and personal tracking purposes only.
  • Always consult with qualified healthcare professionals regarding any medical or mental health concerns.
  • Do not make medical decisions based solely on information from this App.

4. Emergency Notice

If you are experiencing a mental health crisis or emergency, please contact emergency services immediately. This App is not designed to provide emergency assistance. In an emergency, call your local emergency number or go to the nearest emergency room.

5. User Accounts

To access certain features of the App, you may register using your Google account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

6. Usage Rules

When using the App, you agree to:

  • Use the App only for its intended purpose of personal mood tracking.
  • Provide accurate information when creating your account.
  • Not attempt to reverse engineer, decompile, or disassemble the App.
  • Not use the App for any unlawful or unauthorized purpose.
  • Not interfere with or disrupt the App's servers or networks.
  • Not use automated systems to access the App in a manner that sends more requests than a human can reasonably produce.

7. Premium Subscription

Mood Trend offers a Premium subscription with additional features. By subscribing to Premium:

  • You agree to pay the applicable subscription fees ($2.99/month or $24.99/year).
  • Subscriptions are billed through the Apple App Store or Google Play Store and are subject to their respective terms and refund policies.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription through your device's app store settings.
  • No refunds will be provided for partial subscription periods.

8. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, and software — are the exclusive property of the Developer and are protected by international copyright, trademark, and other intellectual property laws.

Your mood data remains your own. We do not claim ownership of the data you input into the App.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

  • The App is provided "as is" and "as available" without warranties of any kind, either express or implied.
  • The Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • The Developer does not warrant that the App will be uninterrupted, error-free, or completely secure.
  • The Developer's total liability for any claims arising from use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause and with or without notice, if we believe you have violated these Terms. Upon termination, your right to use the App will cease immediately. You may also delete your account at any time from within the App.

11. Changes to These Terms

We may update these Terms of Use from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles. Any disputes arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of Japan.
